Garnishee Proceedings, Charging Orders & Contempt Proceedings
Garnishee Proceedings
If you know that someone else owes the debtor money, you can apply to the Court to get an order for that person to pay the money to you instead. Before pursuing this option you should discuss your case with civil enforcement court staff.
You can apply for this action and pay the applicable fee at the Court where the original hearing took place. Forms are available at the Court.
Charging Order
If the debtor owns property, you can apply to get a stay put on their property, preventing them from selling the property until the debt is paid. Before pursuing this option you should discuss your case with civil enforcement court staff.
You can apply for this action and pay the applicable fee at the Court where the original hearing took place. Forms are available at the Court.
Contempt Proceedings
This is an application to have a debtor brought before a District Court Judge because they have breached an order of the Court – such as not keeping to a payment arrangement ordered at an examination hearing. The person can be sentenced to Community Work as a penalty for not obeying the Court order. The penalty does not replace the original civil order i.e. the person still has to pay you what they owe.
You can apply for this action and pay the applicable fee at the Court where the original hearing took place. Forms are available at the Court.
