What happens after your claim is filed
Next steps after you take a claim to the Motor Vehicle Disputes Tribunal.
If the Motor Vehicle Disputes Tribunal has jurisdiction to hear your claim it will register your application as soon as it recieves your completed application.
Notifying the trader
We will send a copy of the claim registration to the trader, with a notice requiring them to discuss the application with you within 14 days of receiving the notice - or any further period that the adjudicator allows.
The trader will be asked to tell the Tribunal in writing about the outcome of those discussions. This is a requirement of the Motor Vehicle Sales Act. If the dispute is not settled by those discussions or we don’t hear back from the trader within 14 days, we will organise a hearing.
Hearing notification
Soon after, we will send you a notice with the time, date and place of the hearing of your application. The earliest a hearing can happen after we receive your application is four weeks. A hearing generally occurs one to two months after you file your claim.
