Before you apply

If you are asking the Review Authority to review a decision on more than one legal aid service or legal service, you need to select the legal aid service or legal service that relates to the decision(s) you want reviewed.  You may choose more than one.

Criminal 1 Civil Immigration/Refugee
Criminal 2 Court of Appeal/Supreme Court

Māori Land Court/Appellate Court/Waitangi Tribunal

Criminal 3 Duty Solicitor Mental Health
Criminal 4 Family Police Detention Legal Assistance

Decide which decisions you are asking to be reviewed

You will then need to identify what parts of the decision you are asking the Authority to review. You can seek a review of the Secretary for Justice’s decision relating to: (you may choose more than one) 

  • Declining your application for approval 
  • Imposing conditions on your approval 
  • Imposing interim restrictions under s101 of the Legal Services Act 
  • Imposing sanctions under s102 of the Legal Services Act
  • Cancelling your approval.

Make sure you have electronic copies of documents if you are applying online.

If you are applying online you will need to have an electronic copy of the original decision and electronic copies of any other information you want to provide to the Authority.

What information should I include with my application?

In your application you need to explain your grounds for a review.

You should provide documents to support your application but you cannot send the Authority any information that was not given to the Secretary for Justice at the time the decision was made.

Application forms

You can apply to the Review Authority if you are:

  • an approved provider, or
  • an applicant for approval.

There are two ways to apply using the Application for Review (PDF, 1.5 Mb) form:

  1. By email: open and complete the editable form, save, and email it to the Authority. Email address details are on the form.
  2. By post: open and print the form, complete by hand and post it to the Authority. Postal address details are on the form.

Legal aid provider applications

If you are:

  • a provider, or 
  • a former listed provider

you may apply to the Legal Aid Tribunal for a review of a decision relating to the amount payable by the former Legal Services Agency for any legal aid services performed under the 2000 Act.
